ProfitGuard Terms of Use (End User License Agreement)

Please read these Terms of Use (“Terms”) carefully before using ProfitGuard. By downloading, installing, or using ProfitGuard, you agree to be bound by these Terms. These Terms form an agreement between you and ProfitGuard (sanva). When distributed via the Apple App Store, Apple’s Standard EULA also applies; where the two conflict, the term more protective of your rights prevails.

1. Service Description

ProfitGuard is a cost-accounting and bookkeeping tool for handmade / Etsy sellers: you enter material costs, labor, and prices, and the app automatically deducts platform fees to calculate true net profit per order / per SKU, plus loss alerts and price suggestions.

2. Important Disclaimer (Not Financial Advice)

All calculations, profit figures, break-even prices, and “price suggestions” ProfitGuard provides are cost-accounting and pricing references based on the data you enter, and do not constitute financial, investment, tax, accounting, or legal advice.

• “Price suggestions” are derived only from the costs and target margin you input and promise no earnings, profit, or return.
• The profit/loss coloring (green / red) in the app merely reflects the accounting result of a record and constitutes no business, investment, or trading advice.
• Platform fee rates are presets; actual rates are those published by each selling platform at the time. You should verify and calibrate them.
• Consult a qualified professional for important business, pricing, and tax decisions. You are solely responsible for any decision made based on this app.

3. Your Data & License

• The SKU, cost, labor, price, and profit data you enter belong to you. You grant us a limited license necessary to provide the service (calculation, storage, sync).
• We process your data per our Privacy Policy and do not sell it or use it to train AI models.
• We grant you a personal, non-exclusive, non-transferable license to use ProfitGuard on devices you own or control.

4. User Conduct

You agree not to: abuse, reverse-engineer, crack, or attempt unauthorized access to the service; upload illegal or infringing content; interfere with normal operation; or impersonate others. We may suspend or terminate your account for violations.

5. Subscriptions & Payment

• ProfitGuard offers a free tier and Pro subscriptions (monthly / yearly). Pro is an auto-renewing subscription.
• Payment is processed by the Apple App Store or Google Play; subscriptions auto-renew within 24 hours before the end of the current period unless cancelled in advance.
• You can cancel anytime in the App Store (Settings → Apple ID → Subscriptions) or Google Play (Profile → Payments & subscriptions). Pro features remain usable until the end of the current period.
• Refunds follow Apple’s and Google’s respective refund rules; we do not double-charge.

6. Intellectual Property

ProfitGuard’s interface, brand, icons, copy, and underlying technology belong to the ProfitGuard (sanva) team and are protected by law. All rights not expressly granted are reserved.

7. Account Security

You are responsible for safeguarding your account credentials. Contact us immediately if you detect unauthorized use.

8. Service Provided “As Is”

ProfitGuard is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no express or implied warranty of uninterrupted, timely, accurate, secure, or error-free operation. To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use or inability to use the service.

9. Changes & Termination

We reserve the right to modify, suspend, or terminate the service (or any part) at any time. Material changes will be announced in-app in advance.

10. Changes to These Terms

We may update these Terms from time to time and will notify you in-app. Continued use constitutes acceptance of the updated Terms.

11. Governing Law

To the extent permitted by law, these Terms are governed by the laws of your place of residence; matters related to Apple distribution are additionally governed by Apple’s Standard EULA.
